BKS Principals Jeni Buckman and Kristin Peer successfully appealed the dismissal of a lawsuit on behalf of BKS client Vichy Springs Resort. In the published decision, Vichy Springs Resort, Inc. v. City of Ukiah (2024) 101 Cal.App.5th 46, the First District Court of Appeal held completion of a construction project did not render CEQA claims against the City of Ukiah moot because effective relief was still possible. Additionally, the Court found that Mendocino County’s determination that it lacked jurisdiction to issue a permit for the construction project did not absolve the County of its CEQA obligations. Securing this favorable decision benefits Vichy Springs Resort and the local community while highlighting the complexity of CEQA litigation.
